  1. Who is eligible to receive a digital MasterCard, ACH deposit, or check?

    To be eligible to receive a digital MasterCard, ACH deposit directly to a bank account or check, the consumer must reside in New York and have filed a complaint with our office regarding being charged fees by New York Sports Club after the consumer’s club went out of business before the consumer’s contract had expired, or who had been unlawfully denied refunds under New York’s Health Club law, including because their club was closed due to the Covid-19 pandemic.

  2. What do I have to do to receive restitution?

    If you meet the eligibility criteria above, you should have received an initial email from EpiqPay on October 12, 2022. This email explained that restitution is being made to New York consumers who had filed a complaint with our office regarding being charged fees by New York Sports Club while its clubs were closed due the Covid-19 pandemic. The email also stated that a second email would follow in which consumers could elect one of three forms of restitution. The second email, received October 13, 2022, requests that you choose either a digital MasterCard, ACH deposit, or a check sent to your home address. If the Settlement Administrator doesn’t receive a response within 30 days, you will receive a check. If you have recently moved, email your current mailing address to the Settlement Administrator at info@newyorksportsclubrestitution.com to ensure receipt.

    If you didn’t receive either of these emails, first check to see if they were blocked and are in your spam or junk mail folders. The subject matter line reads, “Notice of Restitution from New York Attorney General’s Office”. If you believe you are eligible but cannot locate an email, email the Settlement Administrator at info@newyorksportsclubrestitution.com.

  3. Will consumers be compensated for the full amount they paid to New York Sports Club while the clubs were shut down during the pandemic?

    Not in most cases. Because New York Sports Club filed for bankruptcy, the Attorney General was only able to recover for consumers the $250,000 bond it was required to post pursuant to New York’s Health Club law. Therefore, the full restitution of the amounts paid for all consumers is not possible. However, consumers can bring a private action against the company for the remainder of what they paid.

  4. Does everyone receive the same amount?

    Yes. The payment will be approximately $110

  5. Is the restitution check taxable?

    We cannot answer questions about taxes, and we recommend consumers speak to an accountant to answer questions related to taxes. The NY Attorney General will not be issuing a 1099 or any other tax document in relation to this payment.
