During the Covid-19 pandemic, the Governor of New York ordered health clubs to shut down between March 2020 and September 2020. New York law imposes certain requirements on health clubs when they are closed, yet New York Sports Club continued to charge New York consumers fees for their clubs which were not open and could not be used.

Attorney General Letitia James sued the parent companies of New York Sports Club, Town Sports International Holdings, Inc. and Town Sports International, LLC d/b/a New York Sports Club (“NYSC”) and Lucille Roberts. A settlement was reached and restitution of approximately $110 will be distributed to the more than 1,900 New York consumers who were NYSC health club members who filed complaints with the Attorney General’s office.

Eligible consumers will receive two email communications concerning the settlement. The first email notifies consumers that they will receive restitution and informs them they will receive a second email with instructions on how to choose one of three forms of restitution. In the second email, consumers will be able to choose either a MasterCard debit card sent to their email address that can be used wherever MasterCard is accepted, via ACH deposited directly to their bank account, or a check mailed to their home address. If consumers do not make a choice, the Settlement Administrator will send a check.
